Malaysia’s Occupational Safety and Health (Amendment) Act 2022 from 1 June 2024
The Occupational Safety and Health (Amendment) Act 2022 in Malaysia aims to improve workplace safety for everyone, especially employees. Here are the key points simplified for small business owners:
- Expanded Coverage: The Act now covers more types of workplaces, ensuring safety standards apply to a wider range of businesses.
- Stricter Penalties: Businesses that don’t comply with safety regulations face steeper fines and penalties, motivating them to prioritize safety measures.
- Enhanced Employee Rights: Workers have stronger rights to refuse unsafe work conditions without fear of retaliation from their employers.
- Improved Reporting and Investigation: The Act requires businesses to report accidents and incidents promptly, and authorities have more power to investigate workplace accidents thoroughly.
- Better Training Requirements: Employers must provide comprehensive safety training to their workers, ensuring everyone knows how to stay safe on the job.
- 6. Health Protection: The Act also focuses on protecting workers’ health, not just their physical safety, by addressing issues like exposure to hazardous substances.
For example, let’s say you run a small construction business. Under the amended Act, you need to ensure your workers receive proper safety training, provide them with necessary protective equipment, and report any accidents or incidents promptly to comply with the law and keep your employees safe.
From 1 June 2024, Malaysia’s Occupational Safety and Health (Amendment) Act 2022 aims to increase the level of safety and health at workplaces nationwide. As part of initiative to improve workplace safety across all levels, the Act will now require companies to analyse risks in the workplace and also appoint a health safety coordinator, upon the company having five or more employees.
